Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

Mr. Alfieri informed the Commission members that he has been contacted by the Wrentham District Court and notified that the court will only allow 3 continuances from now on.  Therefore, someone must appear on February 23rd for the court date for 887 Lincoln Street.  The same procedure will also affect 880 West Central Street.

There was a motion to accept the minutes of the January 5th meeting.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to accept the minutes of the January 19th meeting with 1 correction.  The   motion was seconded and accepted with a vote of 5-0-0.

Enforcement:  38 Miller Street
Mr. Erik Schwarz, homeowner, appeared before the Commission on an Enforcement matter.  Mr. Schwarz submitted a plan depicting the work he proposes to do on his property.  The plan depicts preexisting and proposed work on his property.



Mr. Schwarz’s plan depicted the plant list of trees to be taken down and replacement trees for the site along with a planting schedule.  The Commissioners provided Mr. Schwarz with some suggestions to enhance the planting plan.  The Commissioners requested that 90% of the specimens would still survive after two years.  

The Chairman stated that the Commission would like to see more plants along with more density, close to 10 ft. on-center.  They were in favor of more diversity.  The sizes of the plants should be bigger.  The Commission members marked up the plan to depict what was discussed for Mr. Schwarz’s use for layout purposes.

The extension and limit of the lawn should be depicted on the plan; i.e., where Mr. Schwarz  would like to have it.

The Chairman summarized the points of the discussion:

  • the amendments to the planting schedule
  • the applicant must show the existing lawn and where the proposed lawn will be located
o       applicant must install compost socks  

Mr. Schwarz will appear at the next meeting on February 16th with the revised plan depicting the above requirements.

Public Hearing – Notice of Intent – Wilson Road Culvert – DPW – CE159-1027
Mr. Ray Willis, Conservation Commission member, recused himself from this public hearing.

Mr. Mike Maglio, Assistant Town Engineer representing the DPW, appeared before the Commission for a railroad bed culvert replacement project behind #1 Wilson Road.  

There was a motion to waive the fees for this project.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

Mr. Maglio gave the Commission a brief description of the proposed project and gave an overview of the plans.

Mr. Alfieri informed the applicant of 6 items to be addressed in this Notice of Intent filing.

The Chairman addressed each of these items with Mr. Maglio and asked how the DPW is planning to address each of these items.

The Chairman stated that DEP’s comments are not applicable to this application.

The Commission members will conduct a site walk on Sunday, February 5th at 9 a.m.

It was questioned as to how will the contractor gain access to the stockpile area?  The sewer line will be 8” PVC pipe to serve the Ivy Lane area.


There was a motion to continue the public hearing until February 16th.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

 
Continued - Public Hearing – Notice of Intent – Grove Street Water Main – DPW – CE159-1026
Mr. Ray Willis, Conservation Commission member, recused himself from this public hearing.

Mr. Donald Nielsen, Engineer of Guerriere & Halnon, and Mr. Deacon Perrotta, Water & Sewer Superintendent for the Town of Franklin, both appeared before the Commission for the installation of a new municipal water main on Grove Street.

The Commission Chairman stated that this hearing has been continued from the last meeting as a DEP file number had not yet been issued.  The DEP file number has now been received and the hearing can be closed.  Mr. Alfieri noted that stamped plans have been received and added to the Conservation file.

There was a motion to close the hearing for the Grove Street Water Main project.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

The Chairman informed the Commission members that Mr. Alfieri has proposed some special conditions to be included in the Orders of Conditions, which are attached to the Agent’s Report.       
A discussion ensued regarding these special conditions.

It was determined that the Town and its consultants have satisfied their burden of demonstrating no adverse individual or cumulative impact.

There was a motion to issue Orders of Conditions with 52 special conditions as discussed in the Agent’s Report with the 2 amendments on 50 and 52.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

GENERAL BUSINESS

Enforcement:  880 West Central Street
The Chairman stated that a letter has been received from the applicant’s representative requesting a continuance until March 1st.

There was a motion to adjourn.  The motion was seconded and accepted with a vote of 5-0-0.
